Tax Regulations in Zambia
The primary tax laws in Zambia are the Income Tax Act, Chapter 323 of the Laws of Zambia, the Value Added Tax Act, Chapter 331 of the Laws of Zambia, the Customs and Excise Act, Chapter 322 of the Laws of Zambia and the Property Transfer Tax Act, Chapter 340 of the Laws of Zambia. These laws outline the taxes applicable to individuals and businesses, detailing registration, filing, and compliance procedures.
Common Prerequisite
Each tax type has its own registration requirements. Notwithstanding, registration for a Taxpayer Identification Number (TPIN) is mandatory for all businesses. Once obtained, the TPIN is used to register various tax types according to the nature of the business, ensuring tax compliance, enabling diverse business activities, and facilitating the opening of bank accounts.
Tax Type Registrations
- Income Tax: Charged on income earned.
- Turnover Tax (TOT): Levied on gross sales/turnover, including earnings, income, revenue, takings, yield, and proceeds.
- Pay As You Earn (PAYE): A system of collecting income tax from employees’ emoluments in proportion to their earnings.
- Withholding Tax: A means of collecting tax, deducted from certain – payments such as management or consultant fees by the payer at the time the payee becomes legally entitled to it.
- Value Added Tax (VAT): A consumption-based tax levied at each point where value is added to a good or service.
- Property Transfer Tax: imposed on a transfer of qualifying property which includes land, shares, mining rights, mineral processing licence and intellectual property.
