Navigating the Employment Permit Appeal Process in Zambia – Why Having the Right Partner Matters

By Marian, Immigration Specialist at Corpus Globe Corporate Solutions (CGCSo)

Securing an Employment Permit (EP) is one of the most crucial steps for foreign nationals who wish to work legally in Zambia. But what happens when an EP application is rejected?

For many companies and expatriates, a rejection can be stressful, potentially disrupting business operations and legal status. Understanding the appeal process is key, and having the right partner can make all the difference.

Understanding the Appeal Process

When an EP application is rejected, the Zambia Department of Immigration (ZDI) will issue a Rejection Notice to the applicant.

🔹 Rejection Notice – If rejected, the applicant has the right to appeal to the Director-General of Immigration (DGI) twice.

  • First Appeal: Must be lodged within seven (7) days of receiving the rejection notice.
  • Second Appeal: If the first appeal is unsuccessful, a second appeal can be submitted within seven (7) days of receiving the second rejection.

🔹 Ministerial Appeal – If the second appeal is also rejected, the applicant may escalate the matter to the Minister of Home Affairs and Internal Security. This appeal must be lodged within 48 hours of receiving the third rejection notice.

Conclusion

The Employment Permit appeal process in Zambia can be complex and time sensitive. Missing a deadline or filing incomplete documentation could cost valuable time and disrupt business operations.
